Marijuana Trafficking

Drug trafficking of marijuana carries a maximum sentence of 15 years in prison and up to a $50,000 fine. Drug trafficking of marijuana in the state of Idaho is defined as any person who knowingly manufactures, delivers, or brings into Idaho:

  • 1 pound or more (but less than 5) of marijuana or 25 marijuana plants or more (but less than 50) is guilty of a felony and will serve a mandatory minimum of 1 year in prison and will pay at least $5,000 in fines.
  • 5 pounds or more (but less than 25) or 50 marijuana plants or more (but less than 100) is guilty of a felony and will serve a mandatory minimum of 3 years in prison and will pay at least $10,000 in fines.
  • 25 pounds or more or 100 marijuana plants or more is guilty of a felony and will serve a mandatory minimum of 5 years in prison and will pay at least $15,000 in fines.

Cocaine Trafficking

The maximum penalty for drug trafficking of cocaine is life in prison and a $100,000 fine. The state of Idaho defines trafficking of cocaine as any person who knowingly manufactures, delivers, or brings into this state 28 grams or more of cocaine or of any mixture or substance containing a detectable amount of cocaine. This person is guilty of a felony. If the quantity involved:

  • Is 28 grams or more (but less than 200 grams) the person will serve at least 3 mandatory years in prison and pay a minimum $10,000 fine
  • Is 200 grams or more (but less than 400 grams) the person will serve at least 5 mandatory years in prison and pay a minimum $15,000 fine
  • Is 400 grams or more the person will serve at least 10 mandatory years in prison and pay a minimum $25,000 fine

Heroin Trafficking 

Any person who knowingly manufactures, delivers or brings into this state 2 grams or more of heroin, or 2 grams or more of any mixture or substance containing a detectable amount of heroin is guilty of a felony. If the quantity involved:

  • Is 2 grams or more (but less than 7 grams) the person will serve at least 3 mandatory years in prison and pay a minimum $10,000 fine
  • Is 7 grams or more (but less than 28 grams) the person will serve at least 10 mandatory years in prison and pay a minimum $15,000 fine
  • Is 28 grams or more the person will serve at least 15 mandatory years in prison and pay a minimum $25,000 fine
